Terms of Use

Competool provides competitive-intelligence tools that help users research brands, review publicly available information, and generate downloadable reports.

You must be at least 18 years old to use Competool.

If you use Competool on behalf of a company or other organization, you confirm that you have authority to accept these Terms on its behalf. In that case, “you” includes both you and the organization.

You may create an account using a magic link or a supported third-party sign-in method, such as Sign in with Google.

You agree to:

• Provide accurate account information.
• Keep access to your email and account secure.
• Notify us if you believe your account has been accessed without permission.
• Accept responsibility for activity performed through your account.

You may not sell, transfer, or share your account access with others or create multiple accounts to avoid trial, usage, or fair-use restrictions.

Competool is currently available through a trial program.

New accounts receive 30 days to use, test, and explore the service, including unlimited report generation during the trial period, subject to the Fair Use section below.

The trial period begins when your account is created.

The current trial:

• Does not require payment information.
• Does not automatically convert into a paid subscription.
• Will not result in a charge unless you separately choose and authorize a future paid plan.

We may change, extend, shorten, replace, or discontinue the trial program as Competool develops. Changes will not result in an automatic charge.

When a trial ends, access to report generation or other features may be limited, paused, or discontinued. We may allow you to continue accessing previously generated reports, but we do not guarantee continued storage or availability after the trial ends.

“Unlimited” trial access means normal product exploration and genuine competitive research. It does not permit activity that abuses the service or interferes with its availability for others.

We may throttle, limit, pause, or refuse usage that we reasonably determine is excessive, automated, abusive, fraudulent, or harmful to Competool or its users.

Examples include:

• Bulk or scripted report generation.
• Using bots, crawlers, scripts, or other automated methods without our written permission.
• Attempting to overload or disrupt our infrastructure.
• Circumventing usage limits, security controls, or access restrictions.
• Creating or sharing accounts to bypass restrictions.
• Extracting or scraping Competool’s underlying database, research results, templates, or methodologies at scale.
• Using the service in a manner that creates unreasonable technical cost or service degradation.

Fair-use limits may change as the product and its infrastructure develop.

Competool grants you a limited, non-exclusive, non-transferable right to access the service and use reports generated through your account for legitimate business purposes.

You may:

• Download and retain reports generated through your account.
• Share reports within your organization.
• Share reports with your employees, contractors, professional advisers, and clients for legitimate business purposes.
• Use report findings in presentations, planning materials, analyses, and business discussions.

You may not, without our written permission:

• Sell or resell Competool reports as standalone products.
• Republish reports as a commercial research library, database, subscription, or competing service.
• Systematically extract report data to recreate Competool or a substantially similar product.
• Remove or misrepresent source attribution.
• Claim that Competool independently verified information when it did not.
• Use reports in a misleading, unlawful, or deceptive manner.

Reports are not exclusive. Other users may receive reports or findings that are similar to yours.

You retain ownership of information you provide to Competool, such as brand names, competitor selections, research instructions, time periods, categories, and other report choices.

You grant Competool a limited right to host, process, reproduce, transmit, and use your inputs as reasonably necessary to:

• Provide and operate the service.
• Generate requested research and reports.
• Maintain report history and account functionality.
• Prevent fraud, abuse, and security incidents.
• Troubleshoot and improve service performance.

You are responsible for ensuring that you have the right to submit your inputs.

Do not submit confidential personal information, sensitive personal information, trade secrets, regulated data, or information that you are not authorized to provide. Competool is designed for business and competitive research, not for storing sensitive personal data.

Competool may use publicly available websites, search services, data providers, artificial-intelligence services, and other third-party tools to locate, organize, summarize, and present information.

Third-party articles, trademarks, logos, images, excerpts, data, and other materials remain the property of their respective owners. Competool does not claim ownership of third-party materials merely because they appear in a report.

Reports may include links or references to third-party websites. Competool does not control or endorse those websites and is not responsible for their availability, security, accuracy, content, or practices.

You are responsible for reviewing any third-party terms, licenses, or restrictions that may apply to your intended use of third-party material.

Competool and its licensors retain all rights in and to the service, including its:

• Software and source code.
• Product design and interface.
• Branding and trademarks.
• Report layouts and templates.
• Research workflows and methodologies.
• Taxonomies, prompts, ranking systems, and data structures.
• Documentation and original content.

These Terms do not transfer ownership of Competool or its underlying technology to you.

You may not copy, reverse engineer, modify, distribute, license, sell, or create derivative products from the service except where applicable law expressly permits it.

You may not use Competool to:

• Break the law or encourage unlawful activity.
• Infringe intellectual-property, privacy, publicity, contractual, or other rights.
• Upload malware or harmful code.
• Attempt to gain unauthorized access to Competool or another user’s account.
• Test or probe the service for vulnerabilities without written permission.
• Interfere with the service or another user’s access.
• Impersonate another person or misrepresent your affiliation.
• Conduct surveillance, harassment, discrimination, or other harmful activity.
• Generate or distribute deceptive, defamatory, or fraudulent material.
• Use Competool’s outputs as the sole basis for decisions that have significant legal, financial, employment, credit, insurance, or similar consequences for an individual.

You may provide ideas, suggestions, or other feedback about Competool.

You grant us permission to use that feedback without restriction or compensation, provided that we do not publicly identify you as its source without your permission.

We work to keep Competool reliable, but the service remains under development.

We do not guarantee:

• Uninterrupted or error-free access.
• That every feature will remain available.
• That every source can be accessed or included.
• That reports will identify every relevant activity or source.
• That generated information will always be complete, current, or accurate.
• That stored reports will remain available indefinitely.

We may add, modify, suspend, or discontinue features or parts of the service at any time.

Competool reports are decision-support tools. They may contain errors, omissions, duplicated information, incomplete findings, outdated information, or generated interpretations that require further review.

Information available online can change, disappear, or be inaccurate. A report may not include every relevant source or development.

You are responsible for independently reviewing and verifying material findings before relying on them.

Competool does not provide legal, financial, investment, accounting, employment, or other professional advice.

You may stop using Competool at any time.

We may suspend, restrict, or terminate your access if:

• You violate these Terms.
• Your activity creates a security, legal, or operational risk.
• Your use violates fair-use restrictions.
• We are required to do so by law.
• We discontinue the service or trial program.

Where reasonably practical, we may provide notice before terminating access, but we are not required to provide advance notice in urgent, abusive, fraudulent, or security-related situations.

Following termination, we may delete your account information, report history, and stored reports, subject to our Privacy Policy and any legal retention requirements.

Sections that by their nature should continue after termination—including ownership, disclaimers, liability limitations, and dispute provisions—will remain in effect.

To the fullest extent permitted by law, Competool is provided “as is” and “as available.”

Competool disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

To the fullest extent permitted by law, Competool and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost opportunities, lost data, business interruption, or reputational harm arising from or related to the service.

To the fullest extent permitted by law, Competool’s total liability for all claims arising from or related to the service will not exceed the greater of:

• The amount you paid Competool during the 12 months before the event giving rise to the claim; or
• US $100.

These limitations apply regardless of the legal theory involved and even if Competool was informed that such damages were possible.

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Competool and its owners, officers, employees, contractors, and affiliates from claims, losses, liabilities, and reasonable expenses arising from:

• Your unlawful or unauthorized use of the service.
• Your violation of these Terms.
• Your inputs or materials.
• Your infringement or violation of another person’s rights.
• Your misuse or misrepresentation of a Competool report.

This obligation does not apply to the extent a claim was caused by Competool’s own unlawful conduct.

Our Privacy Policy explains what personal information we collect and how we use, disclose, retain, and protect it.

By using Competool, you acknowledge the practices described in the Privacy Policy.

We may update these Terms as Competool develops or as legal, security, or operational requirements change.

The “Last updated” date shows when the latest version became effective.

For material changes, we may provide notice through the service, by email, or through another reasonable method. Your continued use of Competool after updated Terms take effect means you accept the updated Terms.

If you do not agree to an update, you must stop using the service.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or Competool will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.

Nothing in this section prevents either party from seeking appropriate relief in small-claims court or seeking urgent relief to protect intellectual property, confidential information, or service security.

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our written permission. We may transfer these Terms as part of a merger, acquisition, financing, corporate reorganization, or sale of all or part of our business.

These Terms and the Privacy Policy constitute the agreement between you and Competool concerning the service, unless we enter into a separate written agreement with you.
